Acceptance of terms of use

These terms of use describe your rights and responsibilities as a user of the Brightlodge Pty Ltd (Brightlodge) website.

By accessing the Brightlodge website and/or creating an account with us, you agree to be bound by these terms of use.

Brightlodge may change, add or remove any functionality of the Brightlodge website or make changes to these terms of use at any time.

Access and use

Brightlodge may agree or refuse your application to access our products at its absolute discretion.

Website, user account and product access

If Brightlodge grants you approval to create an account and accessing our products, you must:

• comply, at all times, with any terms and conditions of the approval, as      outlined in this or any other document; 
• not permit any other person to use your account username and/or password;
• keep your account username and password secure at all times;
• choose a new password whenever you are required to do so;
• not disclose your account password to anyone else;
• advise Brightlodge immediately if you suspect that the security of your account may have been compromised;
• not disclose the information you access after logging in to the Brightlodge website to any person, other than as agreed with Brightlodge;
• only use the information you access after logging in to the Brightlodge website, including our products, as agreed with Brightlodge;
• not disclose, copy, transfer, sell or share the information you access after logging      in to the Brightlodge website, including our products, to any person, other than as agreed with Brightlodge.

Availability and liability

Brightlodge does not warrant that the Brightlodge website and products are error free, or that any defects will be rectified, or that you will have continuous access to your account or our products, nor does it accept liability for any loss, damage, cost or expense (to any person or property) including consequently or indirect loss or any loss of profits, data or revenue that could arise as a result of your use of your account, the Brightlodge website and/or our products.

Intellectual property

Unless otherwise agreed or stated in writing by Brightlodge, all material on this website are the intellectual property of Brightlodge in the right of the State of New South Wales and are owned by Brightlodge in right of the State of New South Wales.

The name "Brightlodge" is used by Brightlodge as a Trade Mark. You acknowledge that Brightlodge owns all intellectual property rights in the Trade Marks in Australia and undertake not to take any action which might:

• invalidate or put in dispute Brightlodge’s title to the Trade Marks;
• oppose any application for registration of the Trade Marks or invalidate or challenge any registration of the Trade Marks in due course;
• support an application to remove any of the Trade Marks as registered Trade Marks;
• cause any Registrar of Trade Marks to require a disclaimer of a monopoly in any of the Trade Marks or part thereof;
• nor will you assist any other person directly or indirectly in any of the above acts.

Severance

If any of these terms of use are held to be invalid, unenforceable or illegal for any reason, the remaining terms will continue in full force.

Governing law

These terms of use are governed by the laws in force in New South Wales, Australia. You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales.
